Service agreement and legal terms

Please read these Terms and Conditions ("Terms," "Agreement") carefully before using the services offered by Mike Welder ("we," "us," or "our"), operating under the domain mikewelder.com. This Agreement sets forth the legally binding terms for your use of our welding and metalwork services and website.
By accessing our website, submitting a service order, or using our welding and metalwork services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Mike Welder provides professional welding and metal fabrication services including but not limited to: custom metal fabrication, structural steel welding, pipe welding and fitting, residential metalwork, equipment repair and restoration, and stainless steel/aluminum welding. Services are provided at our facility and/or at client locations as agreed upon.
Service orders may be submitted through our website order form, by email, or in person. All submitted orders constitute an offer to purchase our services and are subject to our acceptance.
All quotes and estimates provided are valid for 30 days unless otherwise specified. Quotes are based on the information provided by the client and may be adjusted if project requirements change. Final pricing will be confirmed in a written service agreement before work begins.
We reserve the right to decline any project at our discretion. A project is considered accepted when both parties have signed a service agreement or the client has provided written approval of the quote.
A deposit may be required before work begins, typically 50% of the estimated project cost for custom fabrication work. The deposit amount will be specified in your service agreement.
We accept payment by cash, check, credit/debit card, and bank transfer. Payment details will be provided with your invoice.
Final payment is due upon completion of the project and before delivery/installation, unless otherwise agreed in writing. Late payments may incur a service charge of 1.5% per month on outstanding balances.
Cancellations must be made in writing. If you cancel after work has begun:
We reserve the right to cancel projects due to unforeseen circumstances, safety concerns, or inability to meet project requirements. In such cases, a prorated refund will be issued.
We provide a 1-year workmanship warranty on all welding and fabrication work. This warranty covers defects in workmanship under normal use and conditions.
The warranty does not cover: damage from misuse, abuse, or negligence; damage from environmental factors beyond our control; modifications made by others; or normal wear and tear. Material defects are covered under manufacturer warranties where applicable.
To make a warranty claim, contact us at support@mikewelder.com with a description and photos of the issue. We will evaluate the claim and, if valid, repair or remake the defective item at no charge.

To the fullest extent permitted by law, Mike Welder's liability shall be limited to the amount paid for the specific services giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages. This limitation applies regardless of the legal theory under which damages are sought.
You agree to indemnify, defend, and hold harmless Mike Welder, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
By providing your phone number and opting in to SMS communications, you agree to receive text messages from Mike Welder regarding your service orders, project updates, and appointment reminders.
We comply with the Telephone Consumer Protection Act (TCPA) and CTIA messaging guidelines. Mobile opt-in consent is not shared with third parties for marketing purposes.
All content on this website, including text, images, logos, and designs, is the property of Mike Welder and protected by copyright and other intellectual property laws. Custom designs created for clients become the client's property upon full payment.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Hennepin County, Texas.
Before filing any claim, parties agree to attempt good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in Minneapolis, Minnesota, administered by the American Arbitration Association.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated effective date. Your continued use of our services constitutes acceptance of the modified Terms.
These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Mike Welder regarding our services.
